These Terms of Use ("Terms") govern your use of HypnoNest, the websites, web app and mobile apps operated by HypnoNest LLC ("HypnoNest", "we", "us"). By creating an account or using the service you agree to these Terms and to our Privacy Policy.
1. Who can use HypnoNest
You must be at least 18 years old. Practitioners use HypnoNest to run their practice; clients use it to work with a practice that invited them. If you create a practice, the Practice Subscription Terms and Data Processing Agreement also apply.
2. Your account
Keep your sign-in details secret and use the security features we offer, such as sign-in codes and an authenticator app. Tell us at support@hypnonest.com if you think someone else used your account. You are responsible for activity in your account.
3. The relationship between practitioners and clients
HypnoNest is software. We do not provide hypnotherapy, health care, medical or psychological advice, and we are not a party to the relationship between a practitioner and a client. Practitioners are responsible for their services, their qualifications and the records they keep. HypnoNest is not for emergencies; call your local emergency number if you are in crisis.
4. Acceptable use
Do not misuse HypnoNest: no unlawful content or activity, no attempts to access accounts or records you are not authorized to see, no interference with the service, no scraping or automated access except through features we provide, and no uploading of malware.
5. Content
You keep ownership of what you add. You give us the permission we need to host, process and show it to the people you share it with so we can run the service. Practice records are controlled by the practice that keeps them.
6. Payments
Payments to practices are processed by Stripe on the practice's behalf. Refunds and disputes about a practice's services are handled by that practice.
7. AI features
AI features, such as session notes from a transcript, script help and AI voices, produce drafts. The practitioner must review and correct them before relying on them, and stays responsible for the record. A session is transcribed for AI notes only when the client has agreed. We do not use your content to train AI models.
8. Other services you connect
Some features work with services run by other companies, such as Zoom, Stripe or an ElevenLabs account. When you connect or use one, that company's own terms and privacy policy also apply. We are not responsible for those services, and you can disconnect them at any time.
9. Ending your account
You can download your data and request deletion of your account in Account security. You have 14 days to keep your account; after that we delete your login and personal account data. Practices keep their own records about you as the law requires; contact them about those records. We may suspend or close accounts that break these Terms or put others at risk.
10. Changes
We may update the service and these Terms. If a change is material we will ask you to accept the new version before you continue.
11. Disclaimers and liability
HypnoNest is provided "as is" and "as available". To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not promise the service will be uninterrupted or error-free. HypnoNest is a tool for practices; it does not provide therapy, medical advice or emergency services, and practitioners are responsible for the care they give.
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data, and our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim and US $100. You agree to cover our reasonable losses from your misuse of the service or breach of these Terms.
California law governs these Terms, and disputes go to the state or federal courts in Sacramento County, California. Nothing in these Terms limits rights that consumer law in your place of residence gives you and that cannot be waived.
